diligence – ISDA e-contracts analyses ISDA’s e-contract opinions and allows users to rapidly view factors relating to the use of electronic contracts, e-signatures and click-through agreements across derivatives transactions in an intuitive colour-coded web format, including enforceability and admissibility of electronic records in court proceedings.
The service
The International Swaps and Derivatives Association, Inc. (ISDA) and aosphere have launched a service that enables ISDA members to quickly and efficiently assess issues relating to the enforceability of electronically executed and confirmed contracts across the globe.
The tool is hosted on aosphere's aoslogin platform, which also hosts other services that analyse ISDA opinions including netalytics (a joint venture with ISDA) and CSAnalytics.
Good to know
Many organisations who are interested in diligence ISDA e-contracts also have an existing subscription to diligence. diligence is a service which enables users to analyse key pre-insolvency enforceability issues using specifically commissioned aosphere memoranda of law.
For example, it covers the analysis of counterparty capacity and authority to enter into derivatives, consents, recharacterisation, governing law and documentation requirements.
